Allgemeine Geschäfts-bedingungen (AGB)

1. Scope

These general terms and conditions (hereinafter “GTC”) apply to all contracts concluded between Nova Wohnraum Oberfranken GmbH, Spiegel 53, 95326 Kulmbach (hereinafter “Nova Wohnraum”) and its private and business customers (hereinafter “customer”).


2. Conclusion of contract

The contract between Nova Wohnraum and the customer is concluded by signing a written contract, booking online via a booking platform or by booking by e-mail. With the second signature or confirmation of the booking, these terms and conditions are also accepted.


3. Services

Nova Wohnraum offers services in the areas of property management, janitorial services, residential building cleaning and short-term rental of apartments. The exact services are specified in the respective contract.


4. Contractual relationship and role of Nova Wohnraum Oberfranken GmbH


The rental is carried out in someone else's name and for the account of others. The rental service contract is not concluded with the service provider (NOVA Wohnraum Oberfranken GmbH), but directly with the owners (representatives) of the properties. Service providers and contract partners are the respective owners. The identity of the respective owner, including their address and tax number, is stated in the booking confirmation and/or invoice. Payments received through the sales transaction are settled with the representatives.

5. Prices and Payment

• The prices given are binding and include statutory value added tax for private customers, exclusive of statutory value added tax for business customers.
• All payments can be made via bank transfer, Stripe or PayPal.
• For short-term rentals of apartments, payment is due no later than the day of arrival.
• For other services, payment is due within 14 days of invoicing.
• Cash discounts are not accepted.


6. Right of withdrawal and cancellation in the case of short-term rentals of apartments

• The following cancellation conditions apply to short-term rentals, taking into account the exception in accordance with Section 312g Paragraph 2 No. 9 Alt. 1 BGB, according to which a statutory right of withdrawal is excluded:
• If you cancel 1 to 7 days before the agreed date of arrival, 30% of the rental price will be charged
• If you cancel on the day of arrival or a no-show, 100% of the rental price will be charged


7. Deposit for short-term rentals of apartments

In order to cover all claims made by Nova Wohnraum against the customer, Nova Wohnraum is entitled to collect a deposit before providing apartments. For stays of less than three months, the deposit is 250€. For longer
For stays, the deposit is a monthly accommodation rate. If there are no justified claims from Nova Wohnraum, the deposit will be refunded within one month of the termination of the accommodation contract

8. Use and rules of conduct for short-term rentals of apartments

• Pet policy: Pets are not allowed in the apartment. In case of violation, an additional cleaning fee of 100€ will be charged.
• Usage guidelines for common areas: The house rules for common areas must be strictly observed.
• Claim report: Any damage or defects must be reported to Nova Wohnraum immediately after discovery. Failure to report may result in claims for damages against the customer.
• Prohibition of parties and gatherings: Noise in rented living space, common areas and surrounding areas must be avoided. The night's rest must be maintained between 10 pm and 6 am. Parties and gatherings are prohibited. In the event of infringement, Nova Wohnraum may claim compensation for cleaning costs and loss of revenue.
• Smoking ban: Smoking is strictly prohibited in apartments and buildings. In case of violation, a flat cleaning fee of 250€ will be charged.
• Internet usage rules: Internet access may only be used for legal purposes. Any misuse will result in immediate blocking of access.

9. Cleaning and damage in the case of short-term rentals of apartments

• Final cleaning is included in the rent. If the apartment is more than usual when leaving, the customer will be charged for the additional cleaning work of 40€ per hour.
• Damages caused by customers will be claimed in full. This also includes any loss of revenue caused by necessary repairs and downtime.

10. Maintenance and emergencies

In the event of maintenance work or emergencies, Nova Wohnraum can be reached at +4915752015294 or +4915752015292. In the event of urgent repairs, Nova Wohnraum can enter the apartment after prior notice.

11. Transfer, sublease and use in the case of short-term rentals of
flats


Sub-letting or reselling the booked apartment is prohibited. The use of the apartments for purposes other than accommodation is also prohibited. Without the consent of Nova Wohnraum, the use of the rented apartment for photo or video recordings is also prohibited.

12. liability

• Nova Wohnraum is only liable for damage resulting from culpable injury to life, limb or health. In addition, Nova Wohnraum is liable for damage resulting from intentional or grossly negligent breach of duty or insofar as mandatory legal liability regulations exist. Nova Wohnraum is also liable for damage resulting from the culpable breach of essential contractual obligations in the event of slight negligence, but the amount is limited to that at the start of the contract
foreseeable damage typical of the contract. Significant contractual obligations are obligations which protect the customer's main contractual legal positions, which this agreement has just been granted to him in accordance with its content and purpose, and on whose compliance the customer regularly trusts and may rely. Nova Wohnraum's liability is otherwise excluded. The above regulations apply equally to persons for whom Nova Wohnraum is responsible.
• Nova Wohnraum is not liable for failure to fulfill contractual obligations due to force majeure.

13. data protection

• Nova Wohnraum collects, stores and processes clients' personal data exclusively to handle property management, janitorial services, cleaning residential buildings and short-term rental of apartments and to meet legal requirements. This includes names, contact details, payment information, and ID copies. This is based on the customer's consent in accordance with Art. 6 para. 1 lit. a GDPR. In certain cases, this is also done to fulfill a contract in accordance with Art. 6 para. 1 lit. b DSGVO or to fulfill legal obligations in accordance with Art. 6 para. 1 lit. c GDPR.
• Data will only be passed on to third parties if this is necessary to fulfill the contract or if the customer has expressly consented.
• Nova Wohnraum uses technical and organizational security measures to protect data against manipulation, loss, destruction or unauthorized access.
• Personal data is only stored for as long as is necessary to fulfill the stated purposes or as long as there are legal storage obligations.
• Customers have the right to receive information about the stored personal data free of charge upon request. In addition, they have the right to correct incorrect data, block and delete their personal data.
• Customers can contact Nova Wohnraum's data protection officer for questions regarding the collection, processing or use of personal data as well as for information, correction, blocking or deletion of data.

14. Jurisdiction and Applicable Law

• Where permitted by law, the place of jurisdiction for all disputes arising from this contract is Kulmbach. German law applies.
• Should any provision of these terms and conditions be ineffective, the effectiveness of the remaining provisions remains unaffected. The invalid provision must be replaced by one that comes closest to the economic purpose of the ineffective provision.

15. conciliation body

Consumers have the option of contacting the Federal Universal Arbitration Board at the Center for Arbitration e.V. (www.verbraucher-schlichter.de) for disputes that cannot be resolved amicably.
